License-wide duties
What applies by default
The statements above are the library's reading of this license: each is marked with the sentence it rests on, or as a library convention where the text is not explicit. The statements below are the ones the DALICC reasoner supplies for acts the license says nothing about, from the default rules of the dependency graph it reasons with. Each one names the legal source it rests on. None of it is in the record.
-
Promote by default rule (adopted) Using the name or trademarks of the licensor or of contributors to endorse or promote a product.
This license says nothing about Promote, and the graph applies this reading in all jurisdictions it covers: it is not permitted unless the license permits it.
A licence that says nothing about endorsement is read as not allowing it: the licence gives the licensee no right to use the licensor's name or marks in a way that states or implies that the licensor endorses the licensee or its product, while stating truthfully that a work is based on or uses the licensed work is a different act that this rule does not decide. A copyright licence grants rights in the work, and the right to use a name or a trademark is a separate right under trademark law and the protection of names, which a silent copyright licence does not pass on. Combining a licence that is silent about endorsement with one that permits it shows a conflict marked as coming from this rule.
Basis Trademark and name rights are separate from copyright: Regulation (EU) 2017/1001 article 9 lets the proprietor of an EU trade mark prevent all third parties not having his consent from using the sign in the course of trade, and Directive (EU) 2015/2436 article 10, 15 U.S.C. 1114 and 1125(a), section 12 BGB and section 43 ABGB protect marks and names in the same way. The library's evidence is Creative Commons 4.0 section 2(b)(2): Patent and trademark rights are not licensed under this Public License. A copyright licence that is silent grants no right to use the licensor's name or marks to suggest endorsement (Worldwide)

The licence is the end user licence that a UK public body must pass on with Ordnance Survey data published under the INSPIRE Regulations 2009. It is the most restrictive record in the review group: personal, non-commercial use only, no sub-licensing, no distribution, no sale. The record models that correctly. Applied: the licence-wide notice duty required by clause 3.1, which the record was missing and which made it the only record in the library with no attribution or notice duty at all, and a working provenance link, since the recorded URL is dead.

major Rubric 1
dct:sourceappliedcc:legalcode and dct:source both pointed at an Ordnance Survey URL that returns 404, and the current site has no INSPIRE licence page, so the record had no working link to its text. dct:source now points at the Internet Archive snapshot of 30 March 2019, which is the text that was read for this review. cc:legalcode was left at the original URL, because it is the address the licence was published at and changing it would erase that fact; the association should replace it once Ordnance Survey republishes the licence.
-
minor Rubric 1
dct:alternativeproposedThe record has no dct:alternative, so keyword search finds it only by its exact title. Proposed.
-
info Rubric 2
odrl:targetnonedcmitype:Dataset only, which matches Supplied Data, the data a public body provides under the INSPIRE Regulations.
-
info Rubric 3
odrl:permissionnoneOnly reproduce, modify and the no-warranty notice are permitted. Clause 2.1: "The Licensor grants you a non-exclusive, non-transferable licence to use Supplied Data for personal, non-commercial use only (for the avoidance of doubt, this excludes use by you internally within your business)."
-
major Rubric 3
odrl:permissionproposedodrl:modify is permitted, which the text does not support. Clause 2.2: "This Licence is limited specifically to the rights granted in Clause 2.1, and you shall not use the Supplied Data for any other purpose." Clause 2.1 grants use for personal, non-commercial purposes and nothing else; adaptation is not among the granted rights, and the record already prohibits odrl:derive and cc:DerivativeWorks. Proposed for removal rather than applied, because a reading under which personal use includes reformatting the data for one's own viewer is arguable.
-
info Rubric 4
odrl:prohibitionnoneThe prohibitions follow clause 2.1: "You may not sub-license, distribute, sell or otherwise make available any part of the Supplied Data to third parties, save where expressly permitted in writing by the Licensor and OS." odrl:distribute, odrl:grantUse, odrl:display, odrl:present, cc:CommercialUse, the two fee prohibitions and cc:DerivativeWorks all rest on that sentence.
-
minor Rubric 4
odrl:prohibitionproposedcc:ShareAlike and dalicc:addStatement are prohibited, as in the three Open Government Licence records. Neither is supported by the text: the licence says nothing about relicensing terms, for the good reason that it forbids passing the data on at all. Proposed for removal together with the same statements in the other records.
-
major Rubric 5
odrl:dutyappliedThe record carried no duty of any kind and was the single violation of rule 6 of the family-rule baseline, every record needs an attribution or notice duty. The licence has one, clause 3.1: "You shall not alter or remove any of the OS copyright / database right notices and licence numbers which are shown on the Supplied Data." A licence-wide cc:Notice duty was added, licence-wide because the duty is owed for any use and the acts that would normally carry it, distribution and public display, are prohibited here.
-
info Rubric 6
dalicc:WarrantyDisclaimernonedalicc:WarrantyDisclaimer holds clauses 5.1, 5.2 and 5.3 verbatim, including the carve-out for death or personal injury caused by negligence and for fraudulent misrepresentation. There is no separate dalicc:LiabilityLimitation, although 5.2 and 5.3 are liability clauses; splitting the value would be tidier but the text is accurate and complete as it stands.
-
info Rubric 7
cc:jurisdictionnonedalicc:worldwide is a loose fit for a licence granted to an end user for personal use, but the text states no territorial limit, so the field is not wrong. dalicc:perpetual matches clause 4.1, "This End User Licence will continue unless and until terminated by the Licensor or OS where you are in breach of this Licence."
-
gap Rubric 8
recordnoneThe non-transferability of the licence, the personal-use limitation as distinct from the non-commercial one, and the Contracts (Rights of Third Parties) Act clause have no terms. Proposed terms: dalicc:nonTransferable and dalicc:personalUseOnly. The second matters: cc:CommercialUse prohibited says less than the licence does, since internal business use is excluded as well.
-
info Rubric 9
recordnoneThe consistency check reports no conflict, before and after the correction.
-
info Rubric 10
recordnoneThe record has no sibling in the library: it is an end user licence in a review group of open government licences, and its deontic signature is its own. It sits with the Ordnance Survey records by publisher, not by terms.
-
minor Rubric 4
odrl:prohibitionapplieddalicc:promote was prohibited and no sentence of this text supports it. The statement was the library's reading of a legal default, that a copyright licence which says nothing about endorsement grants no right to it, and it sat in 519 of 581 records as a house convention. That reading is now an adopted dalicc:DefaultRule of the core dependency graph, which supplies it to every licence that is silent about the action, so a compatibility check reaches the same answer and the record states only what the text states. Removed on 2026-09-23; see section 13 of docs/LICENSE_REVIEW.md.

Version 2 current2026-09-24 Giray Havur
The content review of 2026-09-15 added 1 license-wide duty, changed 1 identification detail and recorded the review state. Later changes left endorsement to the default rule of the core dependency graph and named the license the record itself is published under.

Version 1
The version this model had before the content review of 2026-09-15.
Every change names the reason behind it: a finding of the content review, one of its library-wide decisions, the metadata that review wrote onto every record, or a hand edit. None of it is legal advice.
Nothing on this page is legal advice. What a license means is decided by its text; ask a legal advisor before you rely on it.
