Changes to the license models

What DALICC changed in its curated models, when, and why.

A license model is corrected when a reading of the legal text turns out to be wrong. Every correction changes what the compatibility checker answers, so each change below names the reason behind it and links to the record it was made on.

This port licenses database rights expressly. Article 3 grants, over and above the copyright acts, the right to "extraire et reutiliser des parties substantielles" when the work is a database protected by the database producer right, the definition of "Oeuvre" covers "une base de donnees dans la mesure ou elle est protegee par le droit d'auteur ou le droit des producteurs de bases de donnees", and the licensor waives its own sui generis right where it holds one: "l'Offrant renonce a ce droit". Article 4(e) adds that article 3 and articles 4(a) and 4(b) do not apply to the part of the work that is covered by the database producer right alone. Because the grant of the database right is explicit in the text, dcmitype:Dataset was added rather than proposed.

This port licenses database rights in its own words, so the asset type is text supported rather than merely plausible. The Estonian port is explicit twice over. Section 1 counts a database inside the licensed work: "Litsentsi tähenduses on Teoseks ka Teose esitus, fonogramm, raadio- ja televisioonisaade, filmi esmasalvestus ja andmebaas selles ulatuses, millises see on kaitstud Eesti autoriõiguse seadusega." Section 3 then disposes of the sui generis right: "Kui Litsentsiandja omab Eesti autoriõiguse seaduse kohaselt, millega on Eesti õiguskorda üle võetud Euroopa Parlamendi ja nõukogu direktiiv 96/9/EÜ, 11. märts 1996, andmebaaside õiguskaitse kohta, sui generis andmebaasi tegija õigusi, loobub Litsentsiandja käesolevaga sellistest õigustest."
